I represent that, to the best of my knowledge, the athlete is physically capable of participating in the selected HYPR Theory activities, except for any medical conditions, injuries, physical limitations, physician restrictions, or other conditions disclosed in this form.

I understand that it is my responsibility to notify HYPR Theory of any material change in the athlete’s health, physical condition, injury status, or activity restrictions before participation.

6. Program Participation Consent

I, the parent or legal guardian of the athlete named above, voluntarily authorize the athlete to participate in the HYPR Theory services and programs selected above. Depending upon the selected service or program, activities may include:

  • Athlete evaluations
  • Speed and performance testing
  • Electronic or laser timing
  • Sprinting
  • Acceleration training
  • Maximum-velocity training
  • Running and sprint drills
  • Plyometrics
  • Jumping
  • Agility and change-of-direction exercises
  • Strength and resistance exercises
  • Individual training
  • Small-group training
  • Team or organization training
  • Camps and clinics
  • Athletic-performance testing and training
  • Use of athletic training and performance equipment, including but not limited to resistance devices, timing systems, strength-training equipment, plyometric equipment, sprint-training equipment, exercise equipment, and other speed, strength, conditioning, testing, and athletic-performance equipment

This authorization remains effective for the athlete’s current and future HYPR Theory participation unless revoked in writing, subject to any requirement that HYPR Theory obtain a new waiver when the terms of this waiver materially change.

7. Assumption of Risk

I understand and acknowledge that athletic training, testing, sprinting, running, jumping, strength training, resistance training, exercise, and sports-performance activities involve inherent risks. These risks may include, but are not limited to:

  • Muscle strains
  • Sprains
  • Joint injuries
  • Ligament or tendon injuries
  • Overuse injuries
  • Falls
  • Slips and trips
  • Cuts and abrasions
  • Collisions
  • Contact with other athletes
  • Contact with coaches or other persons
  • Contact with walls, floors, structures, or surrounding objects
  • Equipment-related injuries
  • Injuries resulting from improper, unexpected, or unintended movement of equipment
  • Injuries resulting from falling onto, against, or from equipment
  • Injuries associated with resistance or tension applied by training equipment
  • Injuries resulting from equipment malfunction, breakage, movement, or misuse
  • Injuries associated with running, sprinting, acceleration, maximum-velocity training, jumping, plyometrics, agility exercises, strength training, resistance exercises, and other strenuous physical activity
  • Fatigue
  • Dehydration
  • Heat exhaustion
  • Heat-related illness
  • Dizziness or fainting
  • Cardiovascular events
  • Heat illness, dehydration, slips, falls, and other injuries resulting from environmental conditions
  • Other foreseeable and unforeseeable injuries associated with physical exercise, athletic testing, equipment use, and athletic training

8. Equipment Risk Acknowledgment

I understand that the athlete may use or come into contact with various types of athletic, exercise, resistance, sprint-training, strength-training, timing, testing, plyometric, and performance equipment. Use of or proximity to such equipment involves inherent risks, including falls, collisions, entanglement, impact, resistance-related injury, equipment movement, equipment malfunction, breakage, misuse, or other equipment-related injury.

I understand that injury may occur even when equipment is properly maintained and used according to coaching instructions.

9. Environmental & Weather Conditions

I understand that training, testing, camps, clinics, team activities, or other HYPR Theory activities may occur indoors or outdoors and may involve environmental risks, including heat, cold, humidity, sun exposure, wind, rain, wet or slippery surfaces, uneven surfaces, changing surface conditions, and other environmental or weather-related conditions.

10. Waiver and Release of Liability

To the fullest extent permitted by applicable Illinois law, I voluntarily release, waive, discharge, and covenant not to sue HYPR Theory Speed Training, Imagine Health, Antony Uscila, and their coaches, trainers, contractors, volunteers, employees, facility owners, landlords, agents, representatives, successors, and assigns (the “Released Parties”) with respect to claims covered by this agreement arising from the athlete’s participation in HYPR Theory activities.

This release does not apply to, and is not intended to release, any liability that cannot legally be waived under Illinois law, including liability for gross negligence or willful and wanton misconduct.

I understand that by signing this agreement I may be waiving substantial legal rights, including certain rights to bring claims or lawsuits.

11. Indemnification

To the fullest extent permitted by applicable Illinois law, I agree to indemnify and hold harmless the Released Parties from claims, damages, losses, liabilities, and reasonable expenses arising out of or related to the athlete’s participation in HYPR Theory activities, except to the extent such indemnification is prohibited by applicable law. Nothing in this provision is intended to require indemnification for conduct for which indemnification cannot legally be required under Illinois law.

12. Emergency Medical Authorization

I authorize HYPR Theory personnel to obtain reasonable emergency medical assistance for the athlete when, in their judgment, it is reasonably necessary and I or the listed emergency contact cannot immediately be reached.

I acknowledge that HYPR Theory personnel are not required to provide medical treatment beyond their training or qualifications, and that I remain responsible for any medical expenses incurred on behalf of the athlete.

13. Athlete Rules & Safety

I acknowledge and agree that:

  • The athlete will follow all coaching and safety instructions and facility safety rules.
  • The athlete will arrive wearing appropriate athletic clothing and footwear suitable for running, sprinting, jumping, strength training, and the scheduled HYPR Theory activities.
  • Equipment may only be used as instructed, and the athlete should not use equipment without authorization from HYPR Theory staff.
  • The athlete should immediately report pain, dizziness, unusual shortness of breath, injury, equipment problems, or other concerning symptoms or conditions.
  • The athlete and parent/guardian are responsible for informing HYPR Theory of relevant injuries, restrictions, or changes in the athlete’s physical condition.
  • HYPR Theory may stop, restrict, or modify participation whenever staff believes doing so is appropriate for athlete or participant safety.
  • Unsafe, disruptive, or inappropriate behavior may result in removal from a training session or program.

14. No Guarantee of Results

I understand that athletic-performance improvements vary between individuals and that HYPR Theory does not guarantee specific improvements in:

  • Speed
  • Acceleration
  • Strength
  • Athletic performance
  • Sports performance
  • Competition results
  • Team selection
  • Playing time
  • Scholarship opportunities
  • Recruitment
  • Any other specific athletic outcome

15. Photo & Video Permission

HYPR Theory may occasionally photograph or record athletes during training for coaching, performance analysis, educational, website, social media, or promotional purposes.

By signing below, I confirm that:

  • I have read the entire agreement.
  • I understand its contents.
  • I have had the opportunity to ask questions.
  • I am the athlete’s parent/legal guardian or am otherwise legally authorized to execute this agreement.
  • I have accurately disclosed relevant medical conditions, injuries, limitations, and physician restrictions to the best of my knowledge.
  • I represent that the athlete is physically capable of participating except as disclosed in this form.
  • I understand the inherent risks associated with athletic testing and training.
  • I understand that use of athletic equipment creates additional risks of injury.
  • I understand that activities may involve contact with athletes, coaches, equipment, surfaces, or surrounding objects.
  • I understand the environmental and weather-related risks where applicable.
  • I voluntarily consent to the athlete’s participation in the services/programs selected above.
  • I understand that this document contains a waiver and release of certain legal rights.
  • I understand the photo/video permission selected above.
  • I intend my electronic signature to represent my agreement and to have the legal effect permitted under applicable law.

18. Electronic Signature

Typing your full legal name constitutes your electronic signature and your agreement to this waiver. The date and time of signing, the athlete and guardian names, and waiver version 2026-08-17.v2 are recorded automatically with your submission.
